really funny you should post this because this is exactly what I was coming to ask everyones opinion on. Ok so here's my dilemma. Im a volunteer firefighter here in the great state of New York. I take a lot of photos for the department and everyone knows I do. However apparently recently we're no longer allowed to take pictures of accidents with people in the cars (not that I would ever do such a thing) because of an incident where someone took pics and posted them on the web of a car accident with a dead person in the car (person was not from my department). Ok anyways I've been told by a few people in my department that I need to ask peoples permission to take pics of accident scenes etc because Im not the department photographer even if Im out in public. So recently they've placed a helicopter at the airport in the village where Im a firefighter. I've shot photos for them before and they use them on their website with my permission. I know 1 of the guys who works for the helicopter company and he's been asking me to get photos of them in action at accident scenes etc, and he's shot pics at their accident scenes before too and they have patients in the pictures. Now am I allowed to do so?? or do I still have to have permission?? personally I think the people in the fire dept dont know what they're talking about and are just saying this so they dont get in trouble for having photos. What are your thoughts??
also a little side note... I know a professional photographer who shoots for espn and sports illustrated etc and he shot the talledega race last year where the car went into the stands and people were hurt and he has a shot of a girl on a backboard that was injured and he told me he can take pics of whatever he wants even if it's people that are hurt. Does this apply to me as well??

i am pretty sure that if you take a picture (or pictures) at an accident scene you dont need arelease to sell them to the paper cause its news(i have done this with nothing more then a paper saying i took the picture) the dead body thing shows no respect for the family but thats just my opinion; an for the guys on the 'copter they seem to be requesting shots,so i dont see a prob there an your right about some of the guys being leary of wanting any photo evidence just so they arent giving the lawyers ammo (ha ha) seeing that everybody is so sue happy these days but this is just my opinion an really what do i know
1 of the guys from the Helicopter e-mailed me back saying that Im allowed to take photos of accident scenes if:
1) my department allows me to
2) No photos of patients faces
So my department is pretty cool with me taking the pics they just dont want to get in trouble so if I follow what the helicopter people are saying when Im getting photos for them hopefully all will go well.
